Terms of service

These Terms of Service govern your use of cautionhotcoffee.com (the "Store") and any purchase you make from it. By placing an order you accept these terms.

1. Who we are
The Store is operated by EsplendoràDeriva – Unipessoal Lda, trading as Caution Hot, NIF/VAT PT518750485, with its registered address at Rua Doutor Almeida Amaral 15A, 1150-137 Lisboa, Portugal. Email: cautionhot.coffeeroasters@gmail.com. Phone: +351 913 832 169.

2. Products
We sell specialty roasted coffee. We make every effort to describe and display our products accurately; however, colours in photos and tasting notes may vary slightly, as coffee is a natural product. All products are subject to availability.

3. Prices and payment
All prices are in euros (EUR) and include Portuguese VAT. Shipping costs are shown at checkout before you pay. Payment is taken at the time of order through the payment methods offered at checkout. We reserve the right to change prices at any time, but changes will not affect orders already confirmed.

4. Orders and contract
After you place an order, you will receive an email acknowledging it. A contract is formed when we confirm and dispatch your order. We may refuse or cancel an order (for example, in the case of an obvious pricing error or stock unavailability); in that case you will receive a full refund.

5. Delivery
Delivery areas, costs and timeframes are described in our Shipping Policy. Risk in the products passes to you upon delivery.

6. Right of withdrawal and returns
Consumers have the right to withdraw from a purchase within 14 days of delivery, subject to the conditions in our Refund Policy. For health and hygiene reasons, opened (unsealed) bags of coffee cannot be returned.

7. Legal guarantee
Consumers benefit from the legal guarantee of conformity under Portuguese and EU law. If a product is defective or not as described, please contact us and we will remedy the problem by replacement or refund.

8. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.

9. Relationship with Shopify
Caution Hot is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Caution Hot. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Caution Hot, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Caution Hot.

10. Intellectual property
All content on the Store, including text, images and logos, belongs to Caution Hot or its licensors and may not be used without permission.

11. Personal data
We process personal data in accordance with our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy: https://www.shopify.com/legal/privacy/app-users

12. Complaints and dispute resolution
If you have a complaint, please contact us first at cautionhot.coffeeroasters@gmail.com. You may also use the Electronic Complaints Book (Livro de Reclamações Eletrónico) at www.livroreclamacoes.pt.
In the event of a consumer dispute, you may turn to an Alternative Dispute Resolution entity, such as the Centro de Arbitragem de Conflitos de Consumo de Lisboa (www.centroarbitragemlisboa.pt). More information is available on the Consumer Portal at www.consumidor.gov.pt.

13. Governing law
These terms are governed by Portuguese law. This does not deprive consumers of the protection of mandatory rules of the law of their country of residence.

14. Changes
We may update these terms from time to time. The version in force at the time of your order applies to that order.
